Spain's Rajoy says he was wrong to trust treasurer in party funding scandal

MADRID (Reuters) - Spanish Prime Minister Mariano Rajoy apologized on Thursday for mishandling a major corruption scandal, but denied he or his center-right People's Party accepted illegal payments and rejected opposition calls to step down.

It was the first time Rajoy had admitted any error since it emerged in January that the ruling party's former treasurer Luis Barcenas - in jail pending trial on charges of bribery and tax evasion - hid up to 48 million euros in Swiss bank accounts.

"I was wrong. I'm sorry but that is how it was. I was wrong in trusting someone we now know didn't deserve it," Rajoy told parliament at the start of a debate on the funding scandal.

He made no other admission of wrongdoing, but acknowledged the scandal has damaged Spain's image abroad at a time when the economy is shrinking and unemployment painfully high.

Investors have shrugged off the scandal as it has not destabilized the government and on Thursday Spain sold debt more cheaply than two weeks ago. A European Central Bank back-stop for ailing euro zone countries has held Spain's borrowing costs at a reasonable level after they spiked up last year and ignited fears of an international bailout.

Barcenas, who left his post in 2009 but continued receiving financial support from the party, told a judge he collected millions in cash donations from construction magnates and distributed them to senior PP figures, including Rajoy.

The Spanish leader has been criticized for maintaining contact with Barcenas up until recently. In January the prime minister sent the former treasurer a text message that read: "Luis. I understand. Be strong. I'll call you tomorrow."

During the debate, opposition leaders from the Socialist and other parties repeated demands that Rajoy quit.

"The only dignified thing for you to do is to step down," said Joan Coscubiela, member of parliament for the Catalan Green Party.

However, Rajoy said he would stay in office and continue with economic reforms which have included spending cuts, tax hikes and rules to make hiring and firing less costly, policies welcomed by investors and Spain's European partners.

Rajoy agreed to testify before lawmakers after opposition parties threatened to call a vote of no confidence in order to force him to take their questions, a sign he was sensitive to public pressure for accountability.

TAXES PAID

Rajoy said he had always declared all his income to tax authorities and said a judicial investigation would prove that there was no illegal financing in the party.

Barcenas, who worked 30 years for the PP, has testified that he maintained for almost two decades a set of shadow accounts tracking a slush fund of cash donations and payments that were hidden from tax authorities and auditors.

Rajoy dismissed the allegations as "a surprising and imaginative collection of lies", and said his party would be vindicated by the official investigation.

"The judge will determine how to proceed with each insinuation but I can tell you now that there was no shadow accounting and no crime was covered up," he said.

The scandal has damaged Rajoy's credibility and eroded voter support for the PP. But with the prime minister expected to hold on to power because the party has a strong majority in parliament, investors have barely reacted.

"There was some market concern about a month ago that Rajoy was going to be forced to resign but since then he's said he would carry out the full term, so no one's really paying attention to it," said Bhavisha Patel, strategist at consultancy 4Cast.

Opinion polls show politicians and political parties are widely mistrusted and the Socialists and the PP have lost significant ground to smaller parties perceived to be more honest.

A Metroscopia poll of 1,000 voters published on Sunday showed 90 percent of respondents thought Rajoy was only taking questions because he had been forced to do so by opposition parties, and 89 percent said they did not believe his answers would clarify what had happened.

Cyclospora outbreak hits 24 cases in Florida

As the cyclospora outbreak reached 372 cases in 16 states, Florida's Department of Health has confirmed the 24th case in the Sunshine State. One of those two dozen patients has been hospitalized with the intestinal infection.

The state is working with the Centers for Disease Control and Prevention and other federal agencies to investigate cases of cyclospora nationwide in an effort to identify the infection's source.

Caused by a single-celled parasite that attacks the small intestine, cyclospora usually causes diarrhea, loss of appetite, weight loss, stomach cramps, bloating, gas, nausea and fatigue. Vomiting, body aches, headache, fever and other flu-like symptoms may also occur, health officials said.

Cyclospora cannot be passed directly from one person to another. It is most commonly spread by ingesting water or uncooked food contaminated with human feces. Cyclospora infections are usually linked to herbs, vegetables and berries.

The outbreak began in Florida in early June. Currently, 14 women and 10 men have been reported to have the infection. Their average age is 57.5 years, with a range of 22 to 78 years of age.

Unlike in other states, the 24 cases in Florida share no common links to restaurants or foods.

Iowa, where the outbreak originated, now has 143 cases. The second-highest number of cases is in Texas, which has reported 101 cases, according to the CDC. Nationwide at least 21 residents have been hospitalized as a result of the infection.

Because symptoms can last several weeks if left untreated, see your health provider if you experience symptoms.

The last significant cyclospora outbreak in Florida was 8 years ago, and was linked to contaminated basil, health officials said.

A MANHUNT has been launched after a 12-year-old girl was raped by two men.

The girl was in Walthamstow, east London, between 12.15am and 12.30am on Saturday when she met three men, Scotland Yard said.

She was taken to a garage area at the end of Hibbert Road, near Theydon Street, where she was pinned down and raped by two of the men.

The girl managed to call a friend who came to the scene and they left together. The suspects then fled from the area.

The trio are described as being between 17 and 19 years old.

The first was dark-skinned and of mixed race, with a diamond stud in his left ear and had a London accent. He told the girl his name was Mo and that he was 17.

He had big brown eyes, short hair, was very skinny and wore a black puffa-style jacket with a hood, black chinos, black trainers and a grey/black T-shirt.

The second was described as black and very tall with big lips. His hair was partly shaven and he wore black trousers and a red and blue shirt.

The third, who did not rape the girl, was black and had a moustache. He wore a blue-coloured hooded top and a red and blue cap, and told her his name was Miles.

Detective Inspector Simon Ellershaw, who is leading the investigation, said: ?This was a very nasty attack on a vulnerable girl just 12 years old by a group of older males who engaged her in conversation before leading her to a secluded area. She was pinned down and two of the males then brutally raped her.

(AP) ? Actress Charlize Theron has pledged her support in the campaign against AIDS during a meeting with South African President Jacob Zuma.

Theron, an ambassador for the United Nations program on AIDS, met Zuma in Pretoria on Monday to discuss the fight against AIDS in South Africa and across the continent.

The South Africa-born actress says the world has the ability to usher in "an AIDS-free generation," and that the goal can become a reality with strong leadership like that displayed by Zuma.

According to UNAIDS, South Africa has reduced the number of new HIV infections by 12 percent in the last two years. Last year, more than 8 million HIV tests were done. However, South Africa wants citizens to get tested at least once a year.

The Rise of the Apple TV: What should be Apple's next step?

The Rise of the Apple TV

Frost & Sullivan recently reported that Apple TV made up more than half of the streaming device market for 2012, beating competitors like Roku and TiVo. Not bad for something that Steve Jobs once referred to as "a hobby" for the company. What should be Apple's next step for the little black box?

First, let's put that news into some context. The Apple TV is the most popular streaming box out there, according to this report - and that's a device that Apple doesn't separately report in its quarterly revenue figures. In fact, the Apple TV's contribution to Apple's balance sheet this past quarter is buried in the "Accessories" portion of its quarterly statement, which for the most recently reported quarter was $1.18 billion (out of $35.23 billion in total revenue).

Compared to the gargantuan revenues of the iPhone ($18.15 billion), the sizable revenues of the iPad ($6.37 billion), or even the Mac ($4.89 billion), that Accessories number is pretty small - especially when you consider that it includes all other Apple-branded hardware peripherals, and accessories made for iPhone, iPad and iPod touch.

But Tim Cook did offer details earlier this year that may give some insight about the success of the Apple TV. In May, Cook said that Apple has sold 13 million Apple TVs to date. About half of those were sold within the previous year, Cook revealed.

That's an average of almost 1.63 million Apple TVs sold each quarter. At $100 a piece, that's $163 million in Apple's coffers from Apple TV each quarter. Some quick back of the envelope math suggests that Apple TV is contributing a little less than 14 percent to Apple's overall "Accessories" revenue numbers. Small potatoes for Apple's balance sheets, perhaps, but if Frost & Sullivan's analysis is correct, a huge chunk of the streaming box market. Apple's biggest competitor, Roku, grabs less than half the remaining pie, according to the report. Other competitors divide what remains into even smaller slivers.

The Apple TV has been around for six years and is already in its third hardware generation. Apple doubling its installed base of Apple TVs in the last twelve months certainly indicates that public momentum for the device is picking up.

But the overall small numbers demonstrate just how nascent the streaming box market really is. While many of us Apple enthusiasts have bought Apple TV, there are still a huge number of consumers who don't find the device particularly useful or interesting, or feel that their TV viewing needs are serviced well enough by cable TV, DVRs and other set-top devices.

Apple's gobbled up a huge piece of a very small pie. But that small market is growing.

Where does Apple go from here?

The second and third generation Apple TV - the small black box - lacks any sort of local storage capability, but makes up for it by being more programmable than its predecessor. Not only is it easily updatable with firmware improvements and other enhancements, but it can be programmed with entirely new apps.

In mid June, Apple rolled out an update for the Apple TV that added support for several new content services including ESPN, HBO, subscription-based anime service Crunchyroll and more.

Some analysts and pundits hope to see the Apple TV become a disruptive technology for television watching - something that people could use in place of cable television altogether. And indeed, some Apple TV users find the content from iTunes, Netflix, Hulu and the other services the Apple TV supports to be sufficient for their viewing habits.

But it's clear that Apple is taking a more iterative approach with the device - an approach that requires customers to have other media at their disposal. Take HBO Go, for example. The app works the same way on the Apple TV that it does on the iPhone and iPad - you can stream HBO content, including current and archived TV series, but it requires you to validate by entering your cable service provider account information first. You can't subscribe to the service a la carte, as it were.

Tim Cook describes a "grand vision" for the Apple TV and calls television itself an "area of intense interest" for the company, but so far he hasn't publicly articulated what that vision is.

According to Frost & Sullivan, the secret to the Apple TV's success is AirPlay, which enables iOS devices and Macs to stream audio and video content to the Apple TV. AirPlay is the killer app for the Apple TV, because it enhances the experience of users of other Apple products by making it easier for them to share content on their television.

Apple implicitly understands this - the company's executives have spoken for years about the "halo effect" of people buying one Apple product and having a great experience with it, then that driving their purchase of more Apple hardware. To that end, AirPlay is getting a big boost in OS X Mavericks, due out later this year. Apple TV owners can already mirror the Mac's display to their television. But with Mavericks' improved Multiple Display support, Mac users will be able to use an Apple TV-connected television as a completely independent display.

The television question

Analysts like Gene Munster have long prognosticated that Apple will build an actual television, but the economics of doing so don't make a lot of sense, at least not right now. Flat panel TVs are an increasingly commodity-drive market, with inexpensive Chinese manufacturers flooding the market with cheap sets you can buy at Walmart and Target.

There may be a window for some new brands to be established in the Ultra HDTV market - the new 4K sets that are coming out. Apple could leverage its legendary supply line muscle with Chinese manufacturers to produce 4K televisions.

And Apple does appear to be making a play for 4K on some of its hardware, like the new Mac Pro, which will feature Thunderbolt 2 interfaces capable of driving 4K resolution displays. But that's a technology that is squarely focused on the high end of Apple's Mac line at the moment, and for the Mac Pro that makes a lot of sense: it's a machine that's historically had a high penetration in the professional digital video and film editing market.

But what, ultimately, would an actual Apple television - 4K or otherwise - gain Apple in the long run? It could establish itself as a niche player - a high end boutique brand, perhaps, but could it muscle itself onto store shelves the same way that competitors like Samsung, LG and Vizio, or long-time players in the field like Sony and Panasonic, have?

Stay the course

It's a smarter play for Apple to continue to to refine the black box with software updates, then roll out a new generation as it makes sense with new features like UHDTV support as it becomes something more consumers are looking for.

While more and more televisions are coming from the factory with "smart" capabilities like connecting to the Internet and to services like Netflix, many consumers continue to use them as simple dumb terminals for their set top boxes and their streaming devices.

For as long as that's the case, Apple's best strategy for the Apple TV remains building a black box that can connect to any of them, instead of building its own branded television. Compared to a television, the Apple TV is almost an impulse buy, and it capitalizes on the halo effect that continues to drive consumers to new Apple products.

ORGANISERS of the 64th Edinburgh Tattoo have unveiled details of this year's world-famous spectacle.

Bandsmen from military bands from New Zealand, Mexico and Mongolia, from were on hand to perform in the city as the announcement was made.

Schoolchildren from Erskine Stewart's Melville College and actors from the Lyceum Youth Theatre will simulate a volcanic lava flow as they spill over the drawbridge of Edinburgh Castle in a dramatic opening to the show.

Some of the best pipers and drummers from around the world, including those from the Black Watch, 3rd Battalion The Royal Regiment of Scotland and The Pipes and Drums of The Royal Guard of Oman, will take part.

There will be a Spring-themed performance by the Republic of Korea Ministry of National Defence Band & Dancers marking the 60th anniversary of the end of the Korean War.

Tattoo producer Brigadier David Allfrey said: "We are hugely excited. The show contains over 80 different musical numbers and we have some remarkable acts both from the United Kingdom and further afield - some of which are at the Tattoo for their first outing.

"We are delighted the Ministry of National Defence team are joining us. We have gone to considerable trouble to secure this exotic and world class act. They come from the land of cherry blossom and it is wholly appropriate that they join us in this anniversary year."

More than 95 per cent of tickets for the three-week run on the Castle Esplanade have already been sold, with 220,000 visitors expected to enjoy the show.

The Tattoo runs from August 2 to 24.

I am sorry, I can not hear you?My Art and Writing Are Speaking too ...

We all need champions in our lives. Someone or something that puts us and our needs first. Something that won?t manipulate, harm, or take.
For me, it is my art and writing that are these champions in my life.

I have conversations with my art and writing all the time for the simple fact they often know more than I am willing to consciously admit.
And, because they refuse to let the voices of others cower them, talk over them, cajole them or manipulate them in any way.

Like no other part of my life, my writing and art stand firm in their beliefs- uncompromised.

Late one night, I did this image. There was no forethought. It?s not my best. I usually prefer symbolism over people. I began with the sky,then the water and the mountains. Suddenly, I knew I needed to sketch in a woman grasping those mountains. She is bigger than life, and she is holding on for dear life.

Hang on...

Nice image?but I did not give it much thought. My life has been in turmoil with some family issues and I was tired by this point. One thing after another has been thrown my way and I lived in the chaos created by others- tossed here and there.

The next morning while reading in a coffee shop, I realize what my art was trying to tell me.

In a book that has little to do with Biblical scripture, I came across the following:

??we are no longer to be children, tossed here and there by waves and carried about by every wind of doctrine, by the trickery of men, by craftiness in deceitful scheming?? Ephesians 4:14.

And I knew. I completely knew. Others seeing the image and reading the passage may have not put these two together, but I did.

My art was telling me to clearly hang on. I did not need to be ?tossed here and there by waves??, especially the waves of others, and by the ?trickery? and ?deceitful scheming? which had become all too common in my life.

The woman grasping the mountains (so symbolic!) is not going to be swept away by the current of chaos in her life. She is big, bigger than life, and she does not need to be in that water any more. IN fact, she is holding herself from the water.

I loved it and in my mind, this was my art shouting at me.
You don?t always need others to tell you about your life. Sometimes they are not exactly the most truthful of opinions.
So, on this day, as others try to tell me ?how it is?, I will remember this image and simply say and gesture:

?Huh?? Sorry, I can?t hear you. My art is speaking loudly to me. It?s all I can hear.?

No death penalty for Snowden if convicted, US says

WASHINGTON (AP) ? Striving to get Edward Snowden back to America, U.S., Attorney General Eric Holder has assured the Russian government the U.S. has no plans to seek the death penalty for the former National Security Agency systems analyst.

In a letter dated Tuesday, the attorney general said the criminal charges Snowden now faces in this country do not carry the death penalty and the U.S. will not seek his execution even if he is charged with additional serious crimes.

Holder's letter followed news reports that Snowden, who leaked details of top secret U.S. surveillance programs, has filed papers seeking temporary asylum in Russia on grounds that if he were returned to the United States he would be tortured and would face the death penalty.

Snowden has been charged with three offenses in the U.S., including espionage, and could face up to 30 years in prison if convicted.

The attorney general's letter was sent to Alexander Vladimirovich Konovalov, the Russian minister of justice.

Holder's letter is part of a campaign by the U.S. government to get Snowden back. When Snowden arrived at Moscow's international airport a month ago, he was believed to be planning simply to transfer to a flight to Cuba and then to Venezuela to seek asylum. But the U.S. canceled his passport, stranding him. Besides applying for temporary asylum in Russia, he has said he'd like to visit the countries that offered him permanent asylum ? Venezuela, Bolivia and Nicaragua.

Some Russian politicians, including parliament speaker Sergei Naryshkin, have said Snowden should be granted asylum to protect him from the death penalty. If Snowden were to go to a country that opposes the death penalty, providing assurances that the U.S. won't seek it could remove at least one obstacle to his return to America.

"I can report that the United States is prepared to provide to the Russian government the following assurances regarding the treatment Mr. Snowden would face upon return to the United States," Holder wrote. "First, the United States would not seek the death penalty for Mr. Snowden should he return to the United States." In addition, "Mr. Snowden will not be tortured. Torture is unlawful in the United States."

Bruce Fein, a lawyer representing Edward Snowden's father, criticized Holder.

"Today the attorney general stated ? apparently thinking he was being conciliatory ? that if Edward Snowden were returned to the United States we wouldn't kill him or torture him. Those are concessions only in the mind of someone who's very biased," said Fein.

He said an impartial prosecutor would have said that Snowden is entitled to a presumption of innocence and that he would guarantee Snowden a fair trial by ensuring it was held in a venue that wasn't populated by NSA contractors.

The attorney general said that if Snowden returned to the U.S. he would promptly be brought before a civilian court and would receive "all the protections that United States law provides."

Holder also said that "we understand from press reports and prior conversations between our governments that Mr. Snowden believes that he is unable to travel out of Russia and must therefore take steps to legalize his status. That is not accurate; he is able to travel."

Despite the revocation of Snowden's passport on June 22, he remains a U.S. citizen and is eligible for a limited validity passport good for direct return to the United States, said the attorney general.

Snowden, who is believed to have been staying at the Moscow airport transit zone since June 23, applied for temporary asylum in Russia last week.

A spokesman for President Vladimir Putin said Russia has not budged from its refusal to extradite Snowden. Said Dmitry Peskov told Russian news agencies that "Russia has never extradited anyone and never will." There is no U.S.-Russia extradition treaty.

Peskov also said that Putin is not involved in reviewing Snowden's application or in discussions with the U.S. of his future with the U.S., though the Russian Security Service, the FSB, had been in touch with the FBI.

Snowden has not overtly threatened to release more damaging documents, though a journalist with whom he has been working, Glenn Greenwald, has said that blueprints detailing how the NSA operates would be made public if something should happen to Snowden.

Putin has said that if Snowden releases any more of the materials, Russia will not grant him temporary asylum.

There's little chance Snowden will be able to use what information he has as a bargaining chip to negotiate his prosecution or extradition.

The government must take the position: "We don't negotiate with extortionists," said Michael Chertoff, the former head of the Justice Department's criminal division and former secretary of homeland security. Chertoff said he can't recall a case in which the U.S. government has caved under this type of threat.

U.S. officials have said what Snowden already has released will harm national security, though it's too early to tell what damage has been done. The U.S. intelligence community has a good idea of what other documents he has.

Fatal shipwreck calls Australia's refugee policy into question

The second such incident in less than a week comes on the heels of an announcement that Australia won't accept new boat arrivals.

Another boat filled with Australia-bound asylum seekers has sunk off the coast of Indonesia. The incident, which has left at least nine people dead, comes almost two weeks?after a similar incident saw the drowning of a 1-year old boy.?

These most recent tragedies throw Australia?s controversial refugee policy into the spotlight, particularly after Prime Minister Kevin Rudd?s announcement last week that all refugees arriving by boat would be turned away.

In this latest incident, authorities believe 204 asylum seekers ? mainly from Sri Lanka, Iran, and Iraq ? boarded a small ship that was only intended to carry 150 passengers in the Indonesian coastal town of Jayanti, reports the Associated Press. The boat, which was headed toward Australia, sank nine hours into the trip. Initial reports indicated that survivors told rescuers there were only about 100 life jackets onboard and that when the boat went down, people who didn't have life jackets clung to pieces of wood.

Indonesia is a popular starting point for refugee hopefuls, as it lies just over 300 miles away from Australia?s Christmas Island.

So far, 189 people have been rescued while nine are confirmed dead, including three children. It is uncertain how many people are still missing.?

Australia is no stranger to tragic incidents involving desperate asylum seekers trying to gain access to the country.?Just two weeks ago, a boat carrying almost 100 migrants, many women and children,?sank off the coast of Christmas Island, reports The Christian Science Monitor. And a 1-year-old baby boy was among the victims.

Since 2009, more than 800 people have drowned trying to make it to Australia, according to figures from the Department of Immigration. Refugee advocates claim the number is much higher because it doesn?t take into account boats that have disappeared without a trace after setting out from the Indonesian island of Java.

Refugee policy is a controversial and oft-debated issue in Australia. The country's history of accepting refugees has come into conflict with concerns over the steep increase in boat arrivals and the implications for Australia?s economy and sovereignty. However, opposition parties have argued that the government's tough stance on the issue has incentivized the use of smugglers, who cram refugees onto boats of dubious quality.

Mr. Rudd announced on July 19, that all refugees arriving in Australia by boat would be transferred to a processing center in Papua New Guinea, where they would remain if their claims were accepted, according to a separate Monitor story last week. More than 15,000 asylum seekers have travelled by boat to Australia this year so far.

Rudd, who came to power last month after unseating former Prime Minister Julia Gillard, has not always held such a hardline position. In 2008, he closed down the offshore refugee processing centers on Nauru and Papua New Guinea that former Prime Minister John Howard had opened as part of his much criticized ?Pacific Solution,? wrote the Monitor in 2009. Instead, refugees were diverted to Christmas Island, where their asylum claims were heard on Australian territory.

But in the face of increasing boat arrivals, the Australian government reopened the offshore detention facilities in 2012. Now, Rudd has hardened the already controversial policy, in a move that has been harshly criticized ?by human rights groups, with Amnesty International accusing it of shirking its moral obligations to help the world's most vulnerable people,? reports Reuters.

The policy change comes ahead of upcoming elections in November, where the issue of asylum seekers is sure to be important. However, this most recent sinking has not changed Rudd?s stance, according to the BBC.

Mr Rudd said that the sinking underlined the need for a policy shift, saying the government had to send "a very clear message to people-smugglers to stop sending people by boat to Australia."

"We are seeing too many drownings, we are seeing too many sinkings, too many innocent people being lost at sea."

New Android-Powered Gaming Console 'Shield' Will Launch July 31 ...

Graphics chip star NVIDIA has set a July 31 release date for its Shield handheld gaming and entertainment device powered by Google's Android software.

The high-performance, handheld gadgets are in full production and will begin shipping at the end of this month, Shield director Jason Paul said in a blog post at the Silicon Valley company's website.

"Last month, we made the difficult decision to delay the launch of Shield due to a mechanical issue we found in our rigorous testing process," Paul said.

"Since then we have been working non-stop to put Shield through its paces and ensure it meets the highest quality control standards in the industry."

NVIDIA has priced Shield at $299 and is taking orders online at nvidia.com and newegg.com. NVIDIA unveiled the portable gaming device at the major Consumer Electronics Show in Las Vegas early this year.

Shield is powered by what NVIDIA boasted to be "the world's fastest mobile processor," the Tegra 4 chip, and device features include a multi-touch display and console-grade controls.

Shield's debut comes as Sony and Microsoft are poised to release new-generation videogame consoles designed to put them at the heart of home entertainment.

Nintendo released its Wii console successor, the Wii U, late last year.

Shield will enter a gaming landscape being transformed by the booming popularity of free play on smartphones or tablet computers.

People are increasingly squeezing play into sessions of five minutes or less sprinkled through the day, according to mobile game industry trackers.

Is India about to become the next hotbed for original pharma research?

Pass the paracetamol.

The Indian pharmaceutical industry could be about to step up to the big league with the launch of a new original diabetes drug, Lipaglyn, developed by homegrown pharma group Zydus Cadilla. With annual revenues of $1bn, Zydus? chairman and managing director Pankaj Patel, expects the new drug, which tackles both high blood sugar and cholesterol in a single pill, to more than double that amount, calling it a potential ?blockbuster?.

Due to be released in the coming months in India, it will take another 3-5 years of clinical trials before being cleared for sale in the more tightly regulated western markets. After years of the Indian pharma industry producing cheap knock-offs of western medicines, it is ?time for India to give back,? according to Patel, ?(having) benefited for years from the research and development efforts in other countries.?

This reputation for a culture of imitation drug production has led to repeated accusations from western pharma companies of poor IP protection by Indian authorities. US giant Pfizer, among others, have called on lawmakers to do more to protect the millions spent on R&D, which will not be turned into revenues if the Indian generics market is allowed to continue churning out cheaper alternatives. This culminated in US Secretary of State John Kerry discussing the issue with Indian policymakers during his recent visit to the country.

But that has still not stopped some companies falling foul of the Indian system, with the Supreme Court rejecting Novartis? bid to protect its new leukemia drug with a patent in January, paving the way for India?s pharma companies to produce generic versions at a fraction of the cost. Gleevec, which can cost up to $31,000 a year in India is now being undercut by the generic version, which costs just $2,100 a year.

Still, Zydus? Lipaglyn could be the start of a move from generics manufacture to original research across the rest of the Indian pharma industry. G. Shah, secretary-general of the Indian Pharmaceutical Alliance, sees this latest development as critical if Indian pharma companies, such as Glenmark and Biocon are to compete on the world stage; ?Our credibility is at stake now? People have been branding us as a?copycat industry, and this is a departure from that,? he said. ?We are not just copycats, but we are transforming into creating original research products also.?

Zydus have spent close to $450m developing new drugs since 2001, while Glenmark spent nearly $1billion on R&D in the last year alone. However, not everyone shares this enthusiasm, with Gayatri Saberwal of the Institute of Bioinformatics and Applied Biotechnology, Bangalore, last year voicing his concern over the Indian pharma sector?s R&D abilities. Based on analysis of the patents being granted in the sector, he found a tiny minority were for genuinely original research, thus making the ?prospects for original drug discovery in India poor,? he said. ?There is probably a long way to go for Indian companies to undertake highly innovative work?.

Just what success the Indian industry is able to achieve internationally will not become apparent on these shores for some time yet, with the development of news drugs taking years. So we will have to stick to our tried and tested remedies in the short term at least, just as the Indian generics industry will also continue to cause a headache for western pharma companies until their original research starts to bear fruit. Pass the parcetamol.

Al Qaeda says it freed 500 inmates in Iraq jail-break

BAGHDAD (Reuters) - Al Qaeda claimed responsibility on Tuesday for simultaneous raids on two Iraqi prisons and said more than 500 inmates had been set free in the operation, one of its most brazen in Iraq.

The Islamic State of Iraq and the Levant, formed earlier this year through a merger of al Qaeda's affiliates in Syria and Iraq, said it had stormed Baghdad's Abu Ghraib jail and another, some 20 km (12 miles) north of capital, after months of preparation.

Monday's attacks came exactly a year after the leader of al Qaeda's Iraqi branch, Abu Bakr al-Baghdadi, launched a "Breaking the Walls" campaign that made freeing its imprisoned members a top priority, the group said in a statement.

Sunni Islamist militants have in recent months been regaining momentum in their insurgency against Iraq's Shi'ite-led government, which came to power after the U.S. invasion to oust Saddam Hussein.

The group said it had deployed suicide attackers, rockets, and 12 car bombs, killing 120 Iraqi guards and SWAT forces in the attacks in Taji, north of Baghdad, and Abu Ghraib, the prison made notorious a decade ago by photographs showing abuse of prisoners by U.S. soldiers.

Interior ministry and medical sources said 29 police and soldiers were killed, and 36 wounded.

"In response to the call of the mujahid (holy warrior) Sheikh Abu Bakr al-Baghdadi to seal the blessed plan of 'Breaking the Walls' ... the mujahideen brigades set off after months of preparation and planning to target two of the biggest prisons of the Safavid government," read the statement posted on militant forums.

Safavid is a reference to the dynasty that ruled Iran from the 16th to 18th centuries and is used by hardline Sunnis as a derogatory term for Shi'ite Muslims.

SYRIA-BOUND

Sectarian tensions across the region have been inflamed by the civil war in Syria, which has drawn in Shi'ite and Sunni fighters from Iraq and beyond to fight against each other.

A senior Iraqi security official said security forces were on high alert and had received information that some of the most high-profile al Qaeda operatives who managed to escape were now on their way to Syria.

Iraq has tightened border controls to prevent them leaving the country, said the official on condition of anonymity: "We are cooperating with the Ministry of Justice to get full descriptions and records of the fugitives to help recapture them and bring them back to prison".

The official added that the level of coordination of the prison raids suggested former military officers had been involved in planning, if not executing them.

Jail-breaks are not unusual in Iraq, but the scale of Monday's assaults prompted some politicians to say that the government had lost any semblance of control over security, which has been steadily deteriorating since late last year.

Insurgents have been regrouping and striking on an almost daily basis, drawing new recruits from the country's Sunni minority, which increasingly resents Shi'ite domination since Saddam's overthrow.

The violence has raised fears of a return to full-blown conflict in Iraq, where ethnic Kurds, Shi'ites and Sunnis have yet to find a stable way of sharing power.

So far in July, almost 700 people have been killed in militant attacks, according to violence monitoring group Iraq Body Count.

That is still well below the height of Sunni-Shi'ite bloodletting that followed the U.S. invasion, when the monthly death toll sometimes topped 3,000.

In 2012, Michael Jordan filed a lawsuit against a Chinese sports wear company, Qiaodan Sports Company Ltd. (?Qiaodan Sports?), for misusing his name as its trademark. The case was finally heard on April 27, 2013 in Shanghai Number Two Intermediate People?s Court. The trademark in dispute, Qiaodan (??), is the Chinese translation of ?Michael Jordan.?

Chinese trademark officeBefore being tried in Shanghai, this case was dismissed by a court in Beijing. The Beijing court accepted Qiaodan Sports? argument that ?Jordan? is a commonly used English name, so using its Chinese version, ?Qiaodan,? does not infringe Michael Jordan?s right specifically.

At trial, Michael Jordan claimed that Qiaodan Sports misled consumers by using his name and his Chicago Bulls jersey number, 23. He requested an order of injunction and compensation of 1.14 million RMB (about $183,000).

Qiaodan Sports, in addition to its prior argument, asserted that they intended ?Qiaodan? to mean ?the grass and woods in the South? in Chinese, rather than ?Michael Jordan.? This argument makes sense because Qiaodan Sports is headquartered in Fujian, a province in the south of China. However, it cannot explain why Qiaodan Sports also registered trademarks for the names of Michael Jordan?s two sons.

The real difficulty for Michael Jordan is not Qiaodan Sports? interesting arguments, but the statute of limitations and the scope of Chinese law. Michael Jordan may fail to bring a timely lawsuit. Pursuant to the General Principles of Civil Law of China, Article 135, the statute of limitations for this case is two years. It runs ?when the entitled person knows or should know that his rights have been infringed upon.? However, the trademark has been used by Qiaodan Sports since 2000. It is difficult to prove whether Michael Jordan had or should have had knowledge of this use during the past twelve years.

Moreover, Chinese civil law may not provide remedies to Michael Jordan. The General Principle of Civil Law of China, according to Article 8, only protects ?foreigners and stateless persons within the People?s Republic of China.? Not having resided in China, Michael Jordan is not likely to be deemed ?within? China under this provision.

This case is still in pending after the parties presented their arguments. In addition to the original claims, Qiaodan Sports has countersued Michael Jordan for damaging its reputation for $8 million in damages. The Quanzhou Court of Fujian Province accepted the company?s complaint on April 2, 2013.

While the Michael Jordan case involves disputes over legally registered trademarks, the bigger trademark problem in China is counterfeit trademarks. A lawyer can easily find potential international cases just by walking down the streets. He may walk into a nice sports wear shop selling shoes labeled ?abidas? or drink a cup of coffee in ?Sunbucks?.

Due to a lack of deterrence and difficulty in enforcement, counterfeit trademarks are everywhere in China. The Chinese Criminal Law provides weak deterrence to trademark crimes. Pursuant to Article 213-15 of the Criminal Law, the person misusing a trademark may be sentenced to fixed-term imprisonment (three to five years), or an uncertain fine. In contrast, a person committing theft can be subjected to life imprisonment. But trademark misuse is more likely than theft to cause huge financial loss. This disproportion of punishment to damage reduces the deterrence to trademark misuse.

On the other hand, even though the law is well designed, its enforcement is not easy in a country with 1,344,130,000 people. There are too many counterfeit trademarks to regulate. No matter how hard the government tries to eliminate them, counterfeit trademarks will regenerate. The government can shut down the ?Sunbucks?, but ?Sonbucks? and ?Moonbucks? will soon show up on the same block.

Considering the weakness of legal regulation in China, foreign companies need to be mindful when they decide to enter this attractive market. Hiring Chinese lawyers to make the most of current Chinese legal system is necessary. On the other hand, to substantially improve the investment environment, the Chinese legislature still has a long way to go.
